Petition for Appropriate Relief

If there has been a violation of the Consent Agreement and Order, the Prosecutor may file a Petition for Appropriate Relief alleging that the professional violated the terms of the Consent Agreement and requesting that Board:

  1. make a probable cause determination that the professional violated the terms and conditions of the agreements;
  2. issue a Preliminary Order vacating its previous Order staying the suspension in this matter, terminating the period of probation and actively responding to the professional’s license.

We will file an Answer on your behalf and request a hearing. Even if you have violated the Consent Agreement by failing a drug screen or failing to comply with other provisions of the original Consent Agreement, there may be mitigating factors involved, when presented to a Hearing Officer, will allow us to successfully argue that the probation be reinstated and that your professional license can become active.
