Are you unable to work after a car accident? You have options.

On Behalf of | Mar 1, 2017 | Injuries

The aftermath of a car accident can be physically painful and financially draining. In an instant, you may be dealing with serious injuries, a totaled car and expenses that you cannot begin to manage on your own. On top of that, catastrophic or very serious damage may leave you unable to work for an extended period of time.

If you find yourself in this situation, you are likely overwhelmed and unsure of what to do next. The inability to work and provide for your family is a serious financial threat, but you may have a valid claim to Social Security Disability (SSD) benefits. It is not always easy to get the money you need, however. Therefore, it may be beneficial to secure experienced legal guidance for this complicated process.

Who is eligible for disability benefits?

According to the Social Security Administration, to qualify for disability benefits, your situation must meet the following stipulations, which include:

  • You have an employment history that includes jobs covered by Social Security.
  • You will be unable to work for a period of at least a year due to your disability.

Benefits will come on a monthly basis until you are able to return to work. There are certain benefits and incentives available to help you transition back to the workplace.

If you have been out of the workforce for many years, never paid into the Social Security system or your work history does not make you eligible for SSD benefits, also known as Social Security Disability Insurance benefits, you have other options. You may be able to secure Supplemental Security Income, an amount determined by your other forms of income.

My claim came back as denied. What can I do now?

After a harrowing car accident, finding out that you did not receive approval for disability benefits can be devastating. While this is certainly a setback, it is not the end of the road for you. You have the right to seek a reconsideration of your application or an administrative appeal. Eventually, you may have the option to file a lawsuit and have your case heard in federal court.

If you are seeking financial support after a serious car accident, you will find it beneficial to secure legal assistance as early as possible in the process. From completing the initial application to seeking an appeal, you do not have to walk this path alone.
