Couples Increasingly Turning To Prenuptial Agreements

According to a recent survey, one thing that couples here in the U.S. are doing more and more now prior to marrying is get a prenuptial agreement.

The survey was conducted by the American Academy of Matrimonial Lawyers. The survey’s respondents were the organization’s member attorneys.

In the survey, 63 percent of respondents said that, over the past three years, they have observed an increase in couples getting prenuptial agreements.

What factors are behind this increase? The president of the American Academy of Matrimonial Lawyers postulated that the improvements the real estate and financial markets are experiencing may be making people more concerned about protecting assets. Such an increased concern could perhaps make couples more likely to turn to a prenuptial agreement.

Another interesting finding of the survey regarded the occurrence of women requesting prenuptial agreements. In the survey, 46 percent of respondents reported having seen an increase in women requesting such agreements.

Prenuptial agreements can address a wide variety of different issues. According to the results of the survey, separate property protection, spousal support and property division are the three matters that show up in prenuptial agreements the most often.

If a couple is considering having a prenuptial agreement, they should think about speaking with an experienced family law attorney. An experienced family law attorney can help a couple determine if having a prenuptial agreement is the right choice for them and can help draft a prenuptial agreement that addresses a couple’s needs and concerns. Having the right terms in a prenuptial agreement can be very important.
